If your Post has had their non-profit status cancelled, they will have to contact IRS. The IRS Exempt Organization Director, Lois Lerner, now says that American Legion Posts may not get their tax-exempt status back by filing a re-inclusion letter with the national organization. This means that all Posts that have been cancelled by the IRS, rightly or wrongly, will have to file for reinstatement under the IRS $100.00 reinstatement program.
Despite the above, any Post who feels that its tax-exempt status was cancelled wrongly or by mistake, may send the details to the National Judge Advocate for submission to the exempt organization director of the IRS. We will try to get errors corrected, but there are no guarantees. This would specifically include any posts who have filed the 990-N prior to May 15, 2010, so that its tax-exempt status should not be cancelled or who took advantage of the October 2010 extension to file. If any Post had its electronic filing rejected, it should bring this information to the attention of The American Legion.
We have been informed of a special toll free number that posts can use to contact the IRS in Cincinnati . This group in Cincinnati is reported to be especially trained in tax exempt issues and may help solve a lot of the problems posts are having. The usual IRS telephone numbers reach people who have not been trained and may not give the proper information. The number to call in Cincinnati is: (877) 829-5500
